Terms and conditions governing access to and use of this website.
1. Purpose and general information
This Legal Notice governs access to, browsing of, and use of the website https://kennedyhumanrightsspain.org (hereinafter, the "Website"), owned by Robert & Ethel Kennedy Human Rights Center Spain (hereinafter, the "Foundation"). Its purpose is to inform the user of the conditions under which the Website is made available, as well as the obligations the user assumes when accessing it.
Access to, browsing of, and use of the Website confer the status of user and imply full and unreserved acceptance of each and every one of the provisions set out in this Legal Notice in the version published at the time of access. Consequently, users are advised to read its content carefully each time they access the Website.
Use of the Website is also governed by the Privacy Policy and the Cookie Policy, which form an integral part of this Legal Notice and which we likewise recommend you read.
2. Identification of the owner
In compliance with the duty to provide information set out in article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), the following identifying details of the owner of the Website are provided:

3. Conditions of use of the Website
The user undertakes to make diligent, lawful, and appropriate use of the Website and its contents, in accordance with applicable law, good faith, public order, and this Legal Notice, refraining from using them for unlawful purposes or effects, or purposes or effects that harm the rights and interests of the Foundation or of third parties, or that in any way may damage, disable, overload, or impair the Website or prevent its normal use.
By way of example and without limitation, the user undertakes not to engage in the following conduct:
- Introducing or disseminating content or computer programs capable of causing damage to the systems of the Foundation or of third parties, such as viruses or other harmful elements.
- Carrying out actions that cause damage, interruptions, or defects in the operation of the Website, or that interfere with its normal use by other users.
- Disseminating unlawful, offensive, or defamatory content, or content that infringes fundamental rights or public freedoms.
- Using the Website to send unsolicited commercial communications or any other form of unauthorized communication.
- Infringing the intellectual or industrial property rights of the Foundation or of third parties.
Where there are sections of the Website with access restricted to registered users, it shall be the user's responsibility to keep their access keys and credentials confidential, being liable for any use made of them. Breach of the foregoing obligations shall entitle the Foundation to adopt the appropriate measures, including the suspension or cancellation of the offending user's access.
4. Intellectual and industrial property
All the contents of the Website, understood as, by way of example, the texts, photographs, graphics, images, icons, logos, trademarks, trade names, technology, software, graphic design, and source code, as well as their selection and arrangement, are owned by the Foundation or by third parties who have authorized their use, and are protected by national and international intellectual and industrial property regulations.
The reproduction, distribution, public communication, transformation, making available, and, in general, any other form of exploitation, in whole or in part, of the contents of the Website, by any means or procedure, without the prior, express, and written authorization of the Foundation or of the holder of the corresponding rights, is expressly prohibited.
Access to the Website does not grant the user any right or ownership over the intellectual or industrial property rights of the content it hosts. Unauthorized use of such content may give rise to the exercise of the corresponding legal actions.
5. Links to third-party sites
The Website may contain links to third-party websites that the Foundation considers to be of interest to the user. Such links are provided for information purposes only, and the Foundation assumes no responsibility for the contents, services, information, or practices of such sites, which are neither under its control nor verified by it.
The existence of these links does not imply the existence of any relationship between the Foundation and the owners of the linked sites, nor the approval or recommendation of their content. Users who access such sites do so at their sole responsibility and are obliged to comply with the terms and conditions and privacy policies applicable therein.
6. Exclusion and limitation of liability
The Website and its contents are made available to the user "as is", without the Foundation granting any warranty as to their accuracy, completeness, timeliness, or fitness for a particular purpose.
The Foundation does not guarantee the permanent availability and continuity of the Website nor the absence of errors in its content, and will use its best efforts to keep it operational and up to date. To the extent permitted by applicable law, the Foundation shall not be liable for damages of any nature that may arise from the lack of availability or continuity of the Website, from the presence of viruses or other harmful elements, from the improper use of the Website by users, or from the information obtained through links to third-party sites.
7. Data protection
The Foundation processes users' personal data in accordance with Regulation (EU) 2016/679, of 27 April, General Data Protection Regulation, and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights. All information relating to the processing of personal data collected through the Website is detailed in the Privacy Policy and in the Cookie Policy.
8. Donations and payment security
Should the user make donations to the Foundation through the Website, payments are processed by specialized payment service providers, by means of secure connections encrypted with the SSL (Secure Socket Layer) protocol, which guarantee the confidentiality of the information transmitted.
The Foundation does not request or collect credit or debit card details or other means of payment via email. Under no circumstances should the user provide this type of confidential information by that means; if they do so, it shall be at their sole responsibility.
9. Amendments to the Legal Notice
The Foundation reserves the right to modify, at any time and without prior notice, the presentation, configuration, and content of the Website, as well as this Legal Notice, in order to adapt it to any applicable legislative, case-law, or technical developments. Users are advised to periodically consult the current version of the Legal Notice published on the Website.
10. Applicable law and jurisdiction
This Legal Notice is governed by Spanish law. For the resolution of any dispute that may arise from access to or use of the Website, and unless applicable regulations mandatorily provide otherwise, the parties submit to the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that might apply to them.
